1. General Disclaimer
Virtual Buyers Agent Pty Ltd (ABN 62 694 217 046) ("VBA", "we", "us", "our") provides a software platform containing property analysis tools, calculators, and educational resources. The information and analysis provided through our platform is for general informational and educational purposes only. Nothing on this platform constitutes personal financial advice, investment advice, legal advice, taxation advice, or any other form of professional advice. The use of this platform does not create a fiduciary relationship, agency relationship, or professional-client relationship between you and VBA.
2. Not a Licensed Service Provider
VBA is NOT a licensed real estate agency, buyers agent, financial advisor, mortgage broker, conveyancer, or legal practitioner. We do not hold an Australian Financial Services Licence (AFSL), Real Estate Licence, or any other professional licence that would authorise us to provide personalised financial or property advice. You should seek independent professional advice from appropriately licensed practitioners before making any property investment decisions.
3. Third-Party Data Sources
Our analysis modules utilise data from third-party sources including but not limited to: Domain API (property listings, sales history, rental data), Australian Bureau of Statistics (demographics, census data), Reserve Bank of Australia (interest rates, economic indicators), and various government planning portals. We do not independently verify this data. Data may be subject to caching (6-24 hours for property data, up to 7 days for census data) and may not reflect real-time market conditions. Third-party data providers may have their own terms of service and limitations.
4. No Property Inspections
VBA does not conduct physical property inspections, building inspections, pest inspections, or any form of on-site due diligence. Our analysis is based solely on publicly available data and cannot identify physical defects, structural issues, pest damage, asbestos, flooding history not recorded in official databases, or other material facts that may affect a property's value or suitability. You must conduct your own due diligence including engaging qualified building and pest inspectors.
5. AI-Powered Features Disclosure
VBA uses artificial intelligence (AI) in several specific features: Smart Property Search, Investor Profile Fit Score, Chatbot Assistant, and our document analysis modules (Contract Extractor, Strata Analyzer, Building Inspector). These features use large language models (LLMs) that may produce inaccurate, incomplete, or inconsistent results. AI-generated content should be verified independently. All other analysis modules (19 of 22) use deterministic, rules-based calculations with transparent logic—these are not AI.
6. Valuation and Forecast Limitations
Any property valuations, rental yield estimates, capital growth projections, or market forecasts provided through VBA are estimates only based on historical data and statistical models. Actual property values, rental returns, and market conditions may differ materially from our estimates. Property markets are inherently unpredictable and affected by factors outside our models including economic conditions, interest rate changes, government policy, local development, and unforeseen events. Our projections should not be relied upon as predictions of future performance.
7. Investment Risk Warning
Property investment involves significant financial risk. Risks include but are not limited to: capital loss, negative cash flow, vacancy periods, interest rate increases, market downturns, property damage, tenant disputes, regulatory changes, and illiquidity. You could lose some or all of your invested capital. Past performance of properties or markets does not guarantee or indicate future results. You should only invest funds you can afford to lose and should consider your personal financial circumstances, investment objectives, and risk tolerance before investing.
8. No Guarantee of Accuracy
While we endeavour to provide accurate and up-to-date information, VBA makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the information, products, services, or related graphics contained on the platform. Any reliance you place on such information is strictly at your own risk. We are not liable for any loss or damage including without limitation, indirect or consequential loss or damage, arising from or in connection with the use of our platform.
9. Professional Advice Required
Before making any property investment decision, we strongly recommend you consult with: a licensed financial advisor (for investment suitability and portfolio allocation), a qualified accountant or tax agent (for tax implications and structuring), a licensed conveyancer or solicitor (for contract review and settlement), a licensed mortgage broker (for financing options), and a registered property valuer (for independent valuation). These professionals can provide personalised advice based on your specific circumstances.
10. Limitation of Liability
To the maximum extent permitted by law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), VBA excludes all liability for any loss, damage, cost, or expense (whether direct, indirect, consequential, or special) arising from or in connection with: your use of or reliance on information provided through the platform; any property investment decision you make; the accuracy, completeness or timeliness of third-party data; technical failures or service interruptions; or any matter outside our reasonable control. Where liability cannot be excluded, our maximum aggregate liability is limited to the amount you paid for the VBA service in the 12 months preceding the claim.
